Line of Duty Act (LODA) invoices for administrative costs

Several members of VML Insurance Programs (VMLIP) have received invoices from the Virginia Retirement System (VRS) for an implementation fee to fund the newly created health benefit program for Line of Duty Act (LODA) recipients and their dependents.

These costs are outside of the LODA coverage provided by VMLIP, and therefore are the responsibility of the member.

VMLIP LODA coverage
History: This July, the VRS assumed responsibility for making LODA eligibility determinations from the Virginia Department of Accounts.

Since assuming this responsibility, VRS has implemented changes including the creation of a new mandated health benefit program for LODA recipients. In order to cover the cost of this new program, all localities with LODA exposure are being charged an implementation fee.

VMLIP LODA Coverage: VMLIP’s LODA coverage provides payment for: costs associated with filing LODA applications and eligibility determinations; investigations conducted by the state; and benefits awarded to qualified member employees and their dependents.

However, VMLIP LODA coverage does not include costs associated with the administration or implementation of new programs enacted by the Commonwealth of Virginia. Therefore, these costs are outside of the LODA coverage provided by VMLIP.

As such, members should make payment on invoices received in relation to this program from the VRS.
