Understanding and Responding to First Amendment Audits

A First Amendment audit occurs when people film public officials or employees to hold them accountable or “test” their right to film in public spaces like town halls, libraries, police stations, parking lots, or Federal, State, and local properties.
These situations often are understandably unfamiliar and stressful for law enforcement, staff, and elected officials, and can lead to claims against local entities.
In this virtual engagement, we will discuss legal considerations, tactics used by auditors, and response measures employees can take when confronted by an auditor.
